Endang Hadrian, S.H., Successfully Leads PT Jaya Real Property in Executing the Seizure of DL Sitorus's Land
PT Jaya Real Property Tbk is the lawful owner of a 6,689-square-meter parcel of land located on Jalan AMD Raya, RT 003/RW 001, Pondok Kacang Barat Village, Pondok Aren District, South Tangerang City. Ownership is evidenced by Building Use Right Certificate (SHGB) No. 1/Pondok Kacang Barat (1994).
PT Jaya Real Property Tbk acquired the property from PT Parigi Graha Permai pursuant to a Joint Agreement Deed No. 15 dated 17 August 1995, as amended by Deed No. 442 dated 28 December 1995, together with a Sale and Purchase Binding Agreement Deed No. 215 and Power of Attorney No. 216, both dated 26 October 1995, executed before Nanny Whyunj, S.H., Notary in Tangerang.
The dispute arose after D.L. Sitorus unlawfully occupied the property by fencing the land, constructing residential buildings, and planting ornamental vegetation without legal entitlement.
Acting as legal counsel for PT Jaya Real Property Tbk, Dr. H. Endang Hadrian, S.H., M.H. successfully represented the client throughout more than a decade of litigation concerning ownership and possession of the property.
After approximately ten years of legal proceedings, the dispute concluded with the successful enforcement of a final and binding court judgment through a court-ordered land execution carried out by the Tangerang District Court.
The execution was conducted pursuant to Tangerang District Court Decision No. 144/PDT.G/2008/PN.TNG and related appellate and cassation judgments, all of which had obtained final and binding legal force (inkracht van gewijsde).
During the execution process, the Court ordered the defendants to vacate the property, thereby restoring PT Jaya Real Property Tbk's lawful possession of the land.
This matter demonstrates Dr. Endang Hadrian's extensive experience in complex land litigation, property rights disputes, and the successful enforcement of final court judgments, representing one of the significant land dispute resolutions in South Tangerang after more than a decade of litigation.
