On the morning of 22 October 2021, the atmosphere in Suradita Village, Cisauk District, Tangerang Regency was markedly different from usual. Numerous law enforcement and security officers gathered at a vacant parcel of land to oversee the court-ordered execution of a final judgment rendered by the Tangerang District Court in a land dispute between Tan Siang Nio, as Plaintiff and Judgment Creditor, and Haetami, as Defendant and Judgment Debtor.
Legal counsel for the Plaintiff, Dr. H. Endang Hadrian, S.H., M.H., explained that the petition for execution became necessary because the disputed property had been unlawfully occupied and the boundary wall surrounding the land had allegedly been damaged by unauthorized parties, despite the existence of a final and legally binding court judgment.
During the execution process, a group of individuals claiming to be the heirs of the property entered the disputed land and attempted to obstruct the installation of a signboard identifying the property as belonging to Tan Siang Nio. Court officials from the Tangerang District Court advised the individuals that anyone claiming legal rights over the property should pursue those claims through appropriate judicial proceedings rather than interfere with the execution of a lawful court order.
The execution was carried out pursuant to the Judgment of the Tangerang District Court No. 21/Pdt.G/2017/PN.Tng, dated 26 July 2017, in conjunction with Execution Order No. 142/PEN.EKS/2021/PN.TNG, dated 30 September 2021, arising from a civil action concerning an unlawful act related to land ownership.
The successful execution of the judgment reflects the enforcement of a final judicial decision and demonstrates Endang Hadrian & Partners' experience in representing clients in complex land ownership disputes, execution proceedings, and property rights litigation before the Indonesian courts.
