Dr. H. Endang Hadrian, S.H., M.H. is an accomplished Indonesian advocate with more than two decades of experience in litigation, dispute resolution, and legal consultancy. Since beginning his legal career in 1998, he has represented corporations, government institutions, and private clients in a broad range of complex civil, commercial, constitutional, and administrative law matters.
He earned his Bachelor of Laws (S.H.) in 1998 and subsequently completed his Master of Laws (M.H.) at Padjadjaran University. He later obtained his Doctor of Laws (Dr.) from Trisakti University, graduating Cum Laude.
His doctoral dissertation, entitled "Dispute Resolution Through Settlement in the Indonesian Civil Justice System and Law Enforcement," proposed four principal concepts aimed at strengthening Indonesia's civil justice system:
The dissertation emphasizes that court-annexed mediation offers a more efficient and cost-effective alternative to litigation. Mediation encourages mutually beneficial settlements (win-win solutions) while reducing litigation costs, shortening dispute resolution time, and alleviating court case backlogs.
The research proposes measures to reinforce the principles of a simple, speedy, and low-cost judicial process. It argues that court-approved settlement agreements should be treated as final and binding judgments, eliminating the need for appeals, cassation, or subsequent litigation, while allowing immediate enforcement.
For appropriate cases, the dissertation recommends allowing parties participating in mediation to provide security or collateral to guarantee compliance with settlement obligations. Such security would strengthen the executory value of settlement agreements and reduce the risk of default.
The dissertation further advocates for the enactment of a comprehensive Indonesian Code of Civil Procedure that specifically regulates mediation as an integral part of civil proceedings. The proposed framework would incorporate mediation principles that reflect Indonesia's legal traditions and societal values while promoting more effective and sustainable dispute resolution.
Through both his academic research and extensive legal practice, Dr. Endang Hadrian has demonstrated a strong commitment to advancing dispute resolution mechanisms, improving access to justice, and promoting legal reform in Indonesia.
