Dr. Endang Hadrian Earns Doctor of Laws Degree with Cum Laude Honors from Trisakti University

Dr. H. Endang Hadrian, S.H., M.H. earned his Doctor of Laws (Dr.) degree from Trisakti University with Cum Laude honors. His doctoral dissertation, entitled "Dispute Resolution Through Settlement in the Indonesian Civil Justice System and Law Enforcement," reflects his longstanding commitment to advancing dispute resolution mechanisms and improving Indonesia's civil justice system.

The dissertation presents four principal concepts designed to strengthen mediation and civil procedure in Indonesia.

First, it emphasizes the significant potential of court-annexed mediation as a more efficient and cost-effective alternative to litigation. Mediation promotes mutually beneficial settlements (win-win solutions), reduces litigation costs and time, and contributes to alleviating court case backlogs.

Second, the research proposes measures to reinforce the principles of a simple, speedy, and affordable judicial process. It argues that court-approved settlement agreements should have the same legal effect as final court judgments, thereby eliminating the need for appeals, cassation, or subsequent litigation while allowing immediate enforcement.

Third, the dissertation recommends that, in appropriate cases, parties participating in mediation should be permitted to provide collateral or security to ensure compliance with settlement obligations. Such security would strengthen the executory value of settlement agreements and reduce the risk of default.

Fourth, the research advocates for the enactment of a comprehensive Indonesian Code of Civil Procedure that specifically regulates mediation as an integral component of civil proceedings. The proposed framework would incorporate mediation principles reflecting Indonesia's legal traditions while providing a modern and effective procedural system.

The dissertation integrates both theoretical and practical perspectives, offering a comprehensive analysis of Indonesia's existing legal framework, including provisions under the Herzien Inlandsch Reglement (HIR), the Indonesian Civil Code (KUHPerdata), and Supreme Court Regulation (PERMA) No. 1 of 2016 on Court-Annexed Mediation. It further develops recommendations intended to support future reform of Indonesia's civil procedural law.

Since beginning his legal career in 1998, Dr. Endang Hadrian has accumulated more than two decades of professional experience representing corporations, government institutions, and private clients in complex civil, commercial, property, land, contractual, constitutional, and administrative law disputes.

In addition to his litigation practice, Dr. Endang Hadrian is registered as a Non-Judge Mediator at the Tangerang District Court, reflecting his professional expertise in both litigation and alternative dispute resolution. His career combines extensive courtroom advocacy with academic scholarship, demonstrating a strong commitment to legal reform, dispute resolution, and the advancement of Indonesia's justice system.
