Jakarta — The construction of the Serpong–Balaraja Toll Road, one of Indonesia's National Strategic Projects, continues to progress. Despite its ongoing development, the project has faced a number of legal challenges, particularly disputes concerning land acquisition. In several instances, compensation payments for affected land have been deposited with the Tangerang District Court through a judicial consignment mechanism pending the resolution of ownership disputes.
Dr. H. Endang Hadrian, S.H., M.H., an advocate based in BSD, South Tangerang, explained that one such dispute involved his client in Civil Case No. 330/Pdt.G/2022/PN.Tng, which was decided by the Tangerang District Court on 18 November 2022.
According to Dr. Endang Hadrian, the dispute began in 2021, when the Land Acquisition Committee officially recognized his client as the owner of a 10,000-square-meter parcel of land in the BSD area. Approximately 6,259 square meters of the property (Land Identification Number/NIB 217) were designated for acquisition as part of the Serpong–Balaraja Toll Road Project.
When the Land Acquisition Committee was preparing to disburse approximately Rp38 billion in compensation to his client, another party unexpectedly asserted a competing inheritance claim over the same property. According to Dr. Endang, the competing claimant relied upon a girik (traditional land registration document) bearing the same registration number and a name that was substantially similar to that of his client, although the documents referred to different individuals and therefore different legal subjects.
As a consequence of the competing claims, the Ministry of Public Works and Public Housing (PUPR) was unable to release the compensation directly to Dr. Endang's client. Instead, the compensation funds were deposited with the Tangerang District Court through a judicial consignment procedure until the ownership dispute could be resolved by a final court judgment.
Following the court proceedings, Dr. H. Endang Hadrian, S.H., M.H. successfully represented his client in establishing the rightful ownership of the disputed property, enabling the legal resolution of the compensation dispute arising from the Serpong–Balaraja Toll Road land acquisition.
The case demonstrates Endang Hadrian & Partners' extensive experience in handling complex land ownership litigation, judicial consignment proceedings, inheritance-related property disputes, and legal matters arising from land acquisition for national infrastructure projects.
