Jakarta — Dr. H. Endang Hadrian, S.H., M.H. officially launched his second book, entitled Settlement of Disputes Through Peaceful Resolution in the Civil Justice System as a Means of Achieving Justice in Indonesia, which explores legal principles and practical approaches to resolving civil disputes through amicable settlement.
"This is my second book, written with the intention of sharing legal knowledge with the public," Dr. Endang Hadrian said in a written statement on 6 September.
Dr. Endang explained that the book focuses on alternative dispute resolution (ADR), particularly the settlement of disputes through peaceful agreement outside the courtroom. It examines the legal standing of Settlement Deeds (Akta Perdamaian), which are legally binding upon the parties in civil disputes, and discusses the legal mechanisms available to ensure that settlement agreements possess full executory force under Indonesian civil procedure.
According to Dr. Endang Hadrian, the publication aims to provide readers with a deeper understanding of how negotiated settlements can serve as an effective and legally enforceable means of resolving civil disputes.
The book further explains that, although Indonesian civil procedure is founded upon the principles of simple, speedy, and low-cost justice, these objectives have not always been effectively realized in practice. As a consequence, courts continue to face significant case backlogs.
Dr. Endang argues that encouraging dispute resolution through peaceful settlement and mediation can substantially reduce the accumulation of cases before the courts while providing parties with a more efficient, cost-effective, and mutually beneficial resolution process.
The publication reflects Dr. Endang Hadrian's continuing contribution to the development of Indonesian civil procedure and alternative dispute resolution, while promoting greater public understanding of peaceful dispute settlement as an integral part of Indonesia's legal system.
