The Tangerang District Court successfully executed a court judgment involving a 1.6-hectare parcel of land located in Suradita Village, Cisauk District, Tangerang, Banten. Although the execution initially encountered resistance from individuals claiming to be the rightful heirs, the court bailiffs successfully carried out the enforcement.
The court bailiffs of the Tangerang District Court were assisted by security personnel from the Cisauk Public Order Agency (Satpol PP), South Tangerang Metropolitan Police, Cisauk Sector Police, Legok Military Command (Koramil), and the Tangerang Regency Military Garrison, ensuring that the execution proceeded safely and in accordance with the law.
At the execution site, Ambo Adi, S.H., Court Bailiff of the Tangerang District Court, stated that although resistance occurred at the beginning of the process, the situation was successfully brought under control with the assistance of law enforcement officers, allowing the execution to proceed without further incident.
"This execution is being carried out to enforce the final and legally binding judgment of the Tangerang District Court in Case No. 21/Pdt.G/2017/PN.Tng. The execution was requested by the judgment creditor's legal counsel, Dr. Endang Hadrian, S.H., and his legal team," the court bailiff explained.
Speaking to the media at the execution site, Dr. H. Endang Hadrian, S.H., M.H., legal counsel for the Judgment Creditor, confirmed that the execution was undertaken solely to enforce the court's final judgment.
"This case involves our client, Tan Siang Nio, as the Judgment Creditor/Plaintiff, against Haetami and others as the Judgment Debtors/Defendants. The legal ownership of the approximately 1.6-hectare property has been clearly established under Freehold Title Certificate (SHM) No. 25/Suradita, dated 16 July 1981, and reaffirmed by the final and binding judgment of the Tangerang District Court in Case No. 21/Pdt.G/2017/PN.Tng. Since the Judgment Debtors failed to comply voluntarily with the court's decision, we petitioned the court for compulsory execution."
The execution was conducted pursuant to the Tangerang District Court Judgment No. 21/Pdt.G/2017/PN.Tng, dated 26 July 2017, in conjunction with Execution Order No. 142/PEN.EKS/2021/PN.TNG, dated 30 September 2021, concerning an unlawful act related to land ownership.
Representing the Judgment Creditor, Endang Hadrian & Partners acted as legal counsel for Tan Siang Nio throughout the litigation and execution proceedings.
According to Dr. Endang Hadrian, the legal status of the property had been clear from the outset. The land, measuring approximately 1.6 hectares, belonged to his client under SHM No. 25/Suradita, issued on 16 July 1981. However, in 2017, the land was excavated and soil was allegedly removed and sold without the owner's authorization, resulting in civil litigation that ultimately concluded in favor of his client.
The successful enforcement of the judgment demonstrates the firm's extensive experience in handling complex land ownership disputes, execution proceedings, and property rights litigation before the Indonesian courts.
