The Urgency of Constitutionalizing the Right to Food in the 1945 Constitution of Indonesia

Abstract

Food is one of the most fundamental human needs and constitutes an essential resource for the survival and development of human civilization. Consequently, the right to adequate food should be viewed from a human rights perspective. As a constitutional democracy, Indonesia should explicitly recognize food as a human rights issue. Accordingly, the State has the obligation to respect, protect, and fulfill the right to food.

In practice, however, Indonesia continues to face significant challenges in ensuring the fulfillment of food as a basic human necessity. Therefore, the right to food should be expressly recognized in the 1945 Constitution of the Republic of Indonesia (UUD 1945).

This study aims to examine the urgency of constitutionalizing the right to food within the 1945 Constitution. The research employs a normative juridical approach.

The findings indicate that regulatory disharmony reflects the government's inability to effectively control development in a manner that safeguards sustainable agricultural land. Failure to adequately protect sustainable agricultural land may ultimately increase Indonesia's dependence on imported food, thereby posing risks to national food security and the realization of the constitutional right to food.
