Executorial Strength of Deed of Peace in Civil Dispute Resolution in Indonesia

Lihat Dokumen

ABSTRACT

Civil dispute resolution can be settled through peace institutions with the legal product in the form of a deed of peace. However, this institution has not been widely used, even though it provides a faster mechanism for civil dispute settlement through its executorial strength. Thus, it offers no further legal remedies, whether in the form of appeals or cassation.

Practically, a deed of peace is recognized as having executorial strength. However, in practice, some parties still pursue further legal actions despite having entered into a peace settlement embodied in a deed of peace.

Optimizing the use of peace institutions with executorial strength is expected to resolve these issues. This study employed a normative legal research method using a legal/judicial perspective focused on the rules and norms of Civil Procedure Law, supported by a comparative legal approach based on legal principles.

The study examined legal rules as standards governing proper legal conduct. It was conducted through an analysis of norms and principles using primary, secondary, and tertiary legal sources.
